OVERVIEW
Welcome to Vintage Town! The terms “we”, “us” and “our” refer to Vintage Town, a sole proprietorship of Julian Ringer, Obertresleinsbach 27, 4723 Natternbach, Austria (see our Legal Notice). Vintage Town operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). Vintage Town is powered by Shopify, which enables us to provide the Services to you.

The terms and conditions below, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully. By visiting, interacting with or using our Services, you agree to these Terms of Service. Information on how we process your personal data can be found in our Privacy Policy.

If you are a consumer, nothing in these Terms limits the mandatory rights you have under applicable consumer protection law.

SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you confirm that you are of legal age in your country of residence or that you are using the Services with the consent of your legal guardian.
To use the Services, including browsing our online store or purchasing products, you may be asked to provide certain information, such as your email address and billing, payment and shipping information. You confirm that all information you provide is correct, current and complete.
You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign or license your account to any other person.

SECTION 2 – OUR PRODUCTS
We sell second-hand vintage clothing. Every piece is unique and may show signs of previous use, which we describe in the product description and show in the photos. We make every effort to show our products as accurately as possible. Colours may look slightly different depending on your screen and device settings.
We reserve the right to discontinue products at any time and to limit the quantities we offer.

SECTION 3 – ORDERS AND CONCLUSION OF CONTRACT
The presentation of products in our online store is not a legally binding offer but an invitation to order. By placing an order, you make a binding offer to purchase. The contract is concluded when we accept your order, at the latest when we send you a confirmation of acceptance or ship the goods. We may decline an order, for example if an item is no longer available. If we do not accept or have to cancel an order, we will inform you without undue delay and refund any payment already made.
Please check your order carefully before submitting it.
Returns and withdrawals are governed by our Refund Policy.
Our products are intended for personal use and not for commercial resale.

SECTION 4 – PRICES AND PAYMENT
All prices are final prices in euros. As a small business under the Austrian small business regulation (Kleinunternehmerregelung), we do not charge VAT. Shipping costs are shown separately before you complete your order. The price that applies is the price shown at the time of your order and set out in your order confirmation.
We may offer promotions from time to time that are subject to separate conditions. If there is a conflict between the conditions of a promotion and these Terms, the conditions of the promotion apply.
You agree to provide current, complete and accurate purchase and payment information and confirm that you are authorized to use the payment method you choose.

SECTION 5 – SHIPPING AND DELIVERY
We ship to the countries listed in our Shipping Policy. Delivery times stated there are estimates. If you are a consumer, the risk of accidental loss or damage passes to you only when the goods are delivered to you or to a third party named by you. If you are a business customer, the risk passes as soon as we hand the goods over to the carrier.

SECTION 6 – INTELLECTUAL PROPERTY
Our Services, including all trademarks, texts, images, graphics, product photos, videos and their design, selection and arrangement, are owned by Vintage Town or its licensors and are protected by copyright, trademark and other intellectual property laws.
You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, publicly display, republish or otherwise use material from the Services without our prior written consent. All rights not expressly granted are reserved by Vintage Town.
Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos and designs on the Services are the trademarks of their respective owners.

SECTION 7 – OPTIONAL TOOLS
The Services may give you access to tools provided by third parties, which we do not monitor or control. Your use of such tools is at your own discretion and subject to the terms of the respective provider. New features we offer in the future are also part of the Services and subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS
The Services may contain links to websites operated by third parties. We are not responsible for the content of these websites. Complaints or questions about third-party products and services should be directed to the respective third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY
Vintage Town is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Vintage Town. Shopify is not a party to the purchase contract between you and Vintage Town and is not responsible for it.

SECTION 10 – PRIVACY
All personal information we collect through the Services is subject to our Privacy Policy. Certain personal information may also be subject to Shopify’s Privacy Policy. Because the Services are hosted by Shopify, Shopify processes personal information about your access to and use of the Services in order to provide and improve them.

SECTION 11 – FEEDBACK AND REVIEWS
If you send us ideas, suggestions, reviews or other content (“Feedback”), you grant us a free, non-exclusive, worldwide and unlimited right to use, reproduce, publish and display this Feedback in connection with our Services. You confirm that your Feedback does not violate the rights of third parties or applicable law and does not contain any unlawful, offensive or misleading content. We may remove Feedback that violates these Terms or applicable law. We are not obliged to respond to Feedback.

SECTION 12 – ERRORS AND OMISSIONS
Information on the Services may occasionally contain errors, for example in product descriptions, prices or availability. We reserve the right to correct such errors. If a contract has already been concluded, our statutory rights, for example to contest the contract because of an error, remain unaffected.

SECTION 13 – PROHIBITED USES
You may use the Services for lawful purposes only. In particular, you may not: (a) use the Services for unlawful or malicious purposes; (b) violate any applicable laws or regulations; (c) infringe our intellectual property rights or those of others; (d) harass, insult, threaten or defame others; (e) submit false or misleading information; (f) send spam or unsolicited advertising; (g) impersonate any other person; (h) upload or transmit viruses or other malicious code; (i) collect personal data of others or scrape, crawl or spider the Services; or (j) interfere with or circumvent the security features of the Services. We may suspend or close your account if you violate these Terms.

SECTION 14 – TERMINATION
We may terminate your access to the Services if you violate these Terms. Contracts already concluded and any amounts owed remain unaffected.

SECTION 15 – WARRANTY
The statutory warranty provisions apply. All our products are second-hand items. Signs of use that are described in the product description or visible in the photos do not constitute a defect. If you discover a defect, please contact us at support@vintagetown.at.
The general information on our website is provided for information purposes only; we do our best to keep it correct and up to date.

SECTION 16 – LIMITATION OF LIABILITY
We are liable without limitation for damage caused intentionally or through gross negligence and for personal injury. In cases of slight negligence, our liability is excluded to the extent permitted by law. Liability under the Austrian Product Liability Act (Produkthaftungsgesetz) and other mandatory statutory liability remains unaffected.

SECTION 17 – INDEMNIFICATION
To the extent permitted by law, you agree to indemnify us against claims by third parties that arise from your culpable breach of these Terms or of applicable law.

SECTION 18 – SEVERABILITY
If any provision of these Terms is or becomes invalid or unenforceable, the validity of the remaining provisions remains unaffected.

SECTION 19 – ENTIRE AGREEMENT
These Terms and the policies published on this website constitute the entire agreement between you and us regarding the use of the Services. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

SECTION 20 – ASSIGNMENT
You may not transfer your rights or obligations under these Terms to third parties without our prior written consent.

SECTION 21 – GOVERNING LAW AND JURISDICTION
These Terms and all contracts concluded under them are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of the protection granted by the mandatory provisions of the law of the country in which you have your habitual residence. For consumers, the statutory rules on jurisdiction apply.

The headings in these Terms are for convenience only and do not affect their interpretation.

SECTION 23 – CHANGES TO THESE TERMS
You can view the current version of these Terms at any time on this page. We may update these Terms for the future. Changes do not affect contracts that have already been concluded; the version in force at the time of your order applies to that order.
